The Supreme Court in Islamabad has ordered the release of two individuals accused of murder after they had spent 12 years in prison. A bench consisting of Justice Jamal Mandokhail, Justice Hasan Azhar, and Justice Naeem Afghan delivered this ruling. The court annulled the previous decisions made by both the trial and high courts. Justice Hasan Azhar Rizvi penned the judgment, which overturned the death sentence of Muhammad Ijaz, also known as Billa, and the life sentence of his accomplice, Naseem Akhtar.

In 2010, Muhammad Ijaz faced accusations of killing the husband of his co-accused, Naseem Akhtar. The plaintiff asserted that the accused caught the victim receiving electric shocks, and upon discovery, Muhammad Ijaz began firing, resulting in the victim’s death. However, the defense lawyer contended that the case misrepresented a suicide as murder. The defense stated that there was no evidence of an illicit relationship between the accused and that the deceased had committed suicide due to not receiving his share of the family inheritance from the plaintiff.

The prosecutor insisted that both defendants intended to kill the victim, and that the plaintiff had witnessed the act. After careful review, the Supreme Court discovered contradictions in the facts and testimony. Although the plaintiff claimed the deceased told him about an unlawful relationship between the defendants, the court pointed out that he was not an eyewitness to this supposed relationship. Furthermore, the deceased did not register any cases against his wife or Muhammad Ijaz.

The court found it shocking that subordinate courts had deemed the relationship illegal without substantial proof. Furthermore, the incident allegedly happened in broad daylight, yet no one could confirm the plaintiff’s version. Records revealed that the co-accused had pushed her husband to get a portion of the family estate, complicating the matter even more.

The court also emphasized the negative impact of the legal procedures on the families involved, highlighting how the deprivation of mothers caused mental suffering in the children. This case emphasizes the need for a comprehensive and fair legal system and strong evidence before finding someone guilty of such a grave offense.

In this long-standing matter, the Supreme Court’s ruling releasing Muhammad Ijaz and Naseem Akhtar marks a significant turning point. It reminds us of the importance of fairness and carefully reviewing all the information before making a decision. The decision relieves the suffering the accused families have endured for over ten years. The court’s decision to revoke the earlier rulings and free the accused draws attention to the shortcomings in the first investigations and trial procedures, therefore stressing the need for a more thorough examination in such grave circumstances.

This case also emphasizes the more significant problem of the legal system and the need to make sure that justice is rendered correctly and free from prejudice. After twelve years in prison, the release of Muhammad Ijaz and Naseem Akhtar marks a fresh chapter in their lives and gives them chances to reconstruct and move forward. It also provides a time for introspection for the legal community and society at large, reminding us of the need for justice and its effects on individuals and families.
